In order to implement United Nations Security Council Resolution 2375 and in accordance with the Foreign Trade Law of the People’s Republic of China, the following management measures are now adopted for some of our products involved in North Korea’s import and export trade:

1. From the date of the announcement, the import of textiles from North Korea will be completely banned (see attachment 1 for the product catalog). If a written trade contract has been signed before the resolution is passed (September 11, excluding the same day) and the customs import procedures have been completed before 24:00 on December 10, it can be released. Starting from 0:00 on December 11, the import procedures for the above-mentioned products will no longer be processed (including goods that have been declared by the customs but have not yet undergone port release procedures). The above-mentioned products entering the country thereafter will be treated as prohibited import goods.

2. It is prohibited to export condensate (customs code: 2709000000, excluding crude oil) and liquefied natural gas (customs code: 2711110000) to North Korea. From 0:00 on the date of implementation of this announcement, export procedures for the above products will no longer be processed (including goods that have been declared by the customs but have not yet gone through port release procedures). The above-mentioned products that will leave the country thereafter will be treated as prohibited export goods.

3. Starting from October 1, 2017, the export of refined petroleum products to North Korea (commodities whose first four customs codes are 2710, 2712, and 2713) will be restricted:

(1) From October 1, 2017 to December 31, 2017, the export of refined petroleum products by United Nations member states to North Korea did not exceed 500,000 barrels (60,000 metric tons); since January 1, 2018 Starting from 2020, exports of refined petroleum products to North Korea will not exceed 2 million barrels (240,000 metric tons) per year. When the quantity limit is approached, the competent authorities of the Chinese government will issue an announcement based on the export situation. From the date of implementation of the announcement, the export of refined petroleum products to North Korea will be prohibited for that year.

(2) Exports of refined petroleum products to North Korea must meet the following conditions:

1. The supply, sale or transfer of refined petroleum products does not involve matters related to United Nations Security Council Articles 1718(2006), 1874(2009), 2087(2013), 2094(2013), 2270(2016), 2321(2016), Any person or entity, including designated individuals or entities, acting on behalf of or on behalf of the DPRK that is associated with North Korea’s nuclear or ballistic missile programs or other activities prohibited by resolutions 2356 (2017), 2371 (2017) or 2375 (2017). Individuals or entities acting under its direction, or entities directly or indirectly owned or controlled by it, or individuals or entities that assist in evading sanctions;

2. The supply, sale or transfer of refined petroleum products is solely for the livelihood of the people of North Korea and is related to generating revenue to support North Korea’s nuclear or ballistic missile programs or in connection with Sections 1718(2006), 1874(2009), 2087(2013), 2094(2013) , 2270 (2016), 2321 (2016), 2356 (2017), 2371 (2017) or other activities prohibited by resolution 2375 (2017).

(3) Enterprises that export refined petroleum products to North Korea must submit a letter of commitment signed by the legal representative or person in charge of the enterprise and stamped with the official seal of the enterprise (Annex 2) to the customs during export declaration.

(4) Aviation fuels that have been banned from being exported to North Korea (including aviation gasoline, naphtha aviation fuel, kerosene aviation fuel, and kerosene rocket fuel) will continue to be subject to the regulations issued by the Ministry of Commerce and the General Administration of Customs in 2016. Announcement is implemented.

This announcement will be effective from September 23, 2017.
