The Jiashan Branch of the Jiaxing Municipal Ecological Environment Bureau found during an inspection of automatic pollution source monitoring data that the automatic monitoring data of a certain printing and dyeing factory in Jiashan County exceeded the standard many times in previous years, but since this year, the automatic monitoring data has dropped off a cliff. Jiashan Branch retrieved sewage treatment plant data, pollution source automatic monitoring data, and solid waste supervision system data and found that the company’s drainage volume, sludge production volume and actual water consumption since this year, The production conditions are obviously inconsistent, and there is suspicion of illegal discharge.
In the early morning of March 31, 2022, law enforcement officers from the Jiashan Branch used the infrared function of a drone to scan the operation conditions of the company’s factory and the wastewater discharge situation at the sewage station and main outlet. They found that the temperature at the main outlet was significantly higher than that in other areas. High, and the temperature of treated wastewater is generally close to normal temperature. At the same time, law enforcement officers checked the company’s real-time discharge data on the pollution source automatic monitoring and management platform, which showed that the discharge volume at this time was close to 0. It was initially determined that the company may be secretly discharging untreated wastewater through a bypass. Law enforcement officers immediately entered the company to conduct a law enforcement inspection and found that a large amount of high-temperature black wastewater was being discharged from the main outlet. After sampling the wastewater being discharged from the main outlet, the monitoring results showed that the chemical oxygen demand was 4140 mg/L and the heavy metal antimony was 1300 μg/L, exceeding the discharge standard by 19.7 times and 12 times respectively. times. After investigation, it was found that there was a pipe in the original pool on the west side of the company’s workshop connected to the reclaimed water reuse pool. The reclaimed water reuse pool was connected to the main outlet pipe. The person in charge of the company admitted that untreated wastewater had passed through the above pipe many times this year. Bypassing sewage treatment facilities and automatic monitoring facilities for pollution sources, they are discharged directly, thereby achieving the illegal purpose of interfering with the sampling of automatic monitoring equipment and tampering with automatic monitoring data.
Investigating the situation
This behavior is suspected of violating Article 39 of the “Water Pollution Prevention and Control Law of the People’s Republic of China”. At the same time, according to the “Interpretation of the Supreme People’s Court and the Supreme People’s Procuratorate on Several Issues Concerning the Application of Law in Handling Criminal Cases of Environmental Pollution” (Legal Interpretation [Legal Interpretation] 2016〕No. 29) Article 1, Paragraph 7, his behavior violated the provisions of Article 338 of the Criminal Law of the People’s Republic of China and was suspected of environmental pollution crimes. The Jiashan Branch transferred the case to the public security organs for further investigation and processing on April 6. Currently, the two suspects have been subject to criminal coercive measures.
